Trademark Registration in Romania with OSIM
We collect the applicant's details and the goods list. We pay the OSIM state fees on your instruction. We work with a partner industrial-property attorney.
- A national mark gives protection in Romania only
- A mark lasts 10 years from filing, and you can renew it
- Romanian citizens and Romanian-law companies pay OSIM fees in lei, and everyone else pays in euro
- Outside the EU and EEA, you need a representative for every step except the filing

How we handle your OSIM trade mark filing
We coordinate trade mark filings at OSIM (Oficiul de Stat pentru Invenții și Mărci, the State Office for Inventions and Trademarks). We do this for founders and companies run from abroad. We collect the details and pay the state fees on your instruction. We also keep the deadline diary. Opinions, oppositions and representation after filing belong to a partner industrial-property attorney.
OSIM keeps the trade mark register (Registrul mărcilor). It is a different register from the Trade Register, where companies are registered. A brand in a regulated sector also needs its licence. That is a separate file at a separate office. See how a CASP is authorised in Romania under MiCA.
What's included
We do administrative work only. The holder is the applicant, you or your company. It is never a third party acting on your behalf.
Intake
We take the applicant's details, the mark, and the goods and services in plain language. The partner attorney then classifies them.
Documents and translations
We collect the documents the file needs and coordinate any translations.
State fees paid on your instruction
We pay the OSIM fees in lei or euro, depending on the applicant. The filing and publication fees go in with the application. Without them OSIM grants no filing date.
A partner industrial-property attorney
We work with a partner consilier în proprietate industrială (industrial-property attorney) on OSIM's national register. The attorney gives every opinion.
Deadline diary
We keep a diary of the three dates on which a client can lose the mark: the examination fee, the certificate fee and the renewal.
A route to a Romanian holder
If a Romanian company is to hold the mark, we set out the routes to get one.
Who the filing is for
OSIM's applicant guide sets the representation rule. The cards give its conditions, not a recommendation.
A founder or company outside the EU and EEA
If you have no domicile, seat or real and effective establishment in the EU or EEA, you need an authorised representative for every step except the filing. Only attorneys who are CNCPIR members and on OSIM's national register can practise.
An applicant with a domicile, seat or establishment in the EU or EEA, including a Romanian-law company
That rule does not catch you. Anyone may apply, alone or jointly, directly or through a representative. A Romanian SRL applies through its administrator.
A business that also needs a sector licence
The trade mark and the licence are separate files at separate offices. See our page on the payment institution license in Romania. See also our guide to which activities need a licence after registration in Romania.
No Romanian company yet
A company can be the applicant only once it exists. You get one by forming an SRL in Romania or by taking over an existing one.

How the process works
These are OSIM's own terms, in order. OSIM publishes no total from filing to certificate.
Search and specify · CLIENT, PARTNER ATTORNEY
You check earlier marks and list the goods and services. The attorney gives any opinion on registrability or conflict. OSIM's optional search (cercetare documentară) is for information only.
Pay the filing and publication fees · CLIENT, US
Both go in with the application. You pay them, or we pay them on your instruction. Without them OSIM grants no filing date.
File the application · CLIENT, PARTNER ATTORNEY
The applicant files online through OSIM's portal. It can also file the PDF form in person, by post or by e-mail. A Romanian SRL files through its administrator. The attorney can file too. We never file.
Publication and observations · OSIM, THIRD PARTIES
OSIM publishes the application within at most 7 days of the filing date. For 2 months from publication, observations may be filed on the absolute grounds in art. 5(1) of Law 84/1998.
Pay the examination fee · CLIENT, US
OSIM's applicant guide gives 30 days from filing. If you do not pay, OSIM deems the applicant to have withdrawn and rejects the application. We advise paying it with the filing.
Examination and opposition · OSIM, THIRD PARTIES, PARTNER ATTORNEY
OSIM examines on the merits within 6 months of publication, once the fees are paid. Then it admits or refuses the mark. Any interested person may oppose. The time limit is two months from the BOPI publication of the admission (art. 6).
Registration certificate · CLIENT, OSIM
OSIM's applicant guide gives 30 days from the notice that the procedure has ended. That is the time to pay the 254 lei certificate fee. If you do not pay, OSIM treats the registration as given up. Another OSIM text differs.
Renewal · CLIENT, US
A mark is valid for 10 years from filing. You can renew it for further 10-year periods. A late renewal is possible within 6 months after expiry, at the fee raised by 50%.

Want the mark and the goods list collected before any fee is paid?
Send us the applicant's details and the mark. We collect the goods and services list in plain language. We pass it to the partner attorney before any fee goes to OSIM.

- The mark: the word itself, or the image for a figurative mark
- The goods and services, described in plain language
- Proof of payment of the OSIM filing and publication fees

OSIM state fees for 2026
The applicant owes four state fees for one class and an individual word mark in black and white. They are filing, publication, examination and certificate. You pay them to OSIM, and they are not our fee. A renewal also carries a renewal certificate fee (item 9). The opponent pays the opposition fee.

Problems we solve
This section covers what can cost founders a mark or a fee, and how we handle it.
OSIM's own texts disagree on two deadlines
OSIM's applicant guide gives 30 days from filing for the examination fee. It gives 30 days from the notice for the certificate fee. Another OSIM text differs on both. We diarise the guide's terms.
"How long will it take, and will it be registered?"
OSIM publishes component terms, not a total. The decision is OSIM's. Paying fees guarantees nothing, and the EUIPO refunds nothing on rejection. We promise neither a date nor a result.
A class heading is not a shortcut
A class heading is read as covering everything within its literal meaning. The list must be precise. If OSIM's examiners do the classification, it costs 152 lei.
An invoice you did not expect
The EUIPO states that it never sends invoices or letters requesting direct payment for services to users. We hold no such statement from OSIM and make none.
The 2026 SME Fund trade mark voucher has closed
OSIM announced that voucher 2 for trade marks and designs closed on 23 April 2026, when the funds ran out. We state no later round here.
Does your mark need an opinion before anything is filed?
Tell us the mark and its goods. The partner attorney gives the opinion, and we keep the file in step.
Why work with RomaniaRegist
Victor Georgescu leads licensing and founder immigration. He runs the trade mark file from our Bucharest office, in Romanian, English and German.
In our practice, every opinion on a mark goes to the partner attorney. Every fee date goes into the diary.
We are a trust and company service provider notified to ONPCSB. We check identity and beneficial-owner documents first (Law 129/2019 art. 2(l), 5(1)(g)).
Frequently asked questions
Do I need a Romanian trade mark attorney if I live outside the EU?
Yes, for every step after the filing, but not for the filing itself. If the applicant has no domicile, seat or real and effective establishment in the EU or EEA, OSIM requires an authorised representative (mandatar autorizat). The representative acts at every step except the filing. OSIM authorises industrial-property attorneys (consilieri în proprietate industrială) and keeps their register. The partner attorney we work with is one.
Can my Romanian SRL file the trade mark itself, without a representative?
A company seated in Romania is not caught by the representation rule. The rule applies to an applicant with no domicile, seat or establishment in the EU or EEA. The company applies through its administrator or through a representative. We do not file in the client's name. The client or the partner attorney files.
Does a Romanian trade mark protect my brand in other EU countries?
No. A mark registered with OSIM is protected only in Romania. An EU trade mark, filed with the EUIPO, has unitary character and equal effect throughout the Union. The two routes have separate offices, fees and opposition periods. The partner attorney advises on the choice between them, not us.
Should I register with OSIM or file an EU trade mark at the EUIPO instead?
We recommend no route. The facts that differ are territory (Romania only against the whole Union), the fees, the opposition period (two months against three) and the office. Both marks last 10 years from filing. The comparison table above sets them side by side. The partner attorney advises on which fits your brand.
Is my company name at the Trade Register already protected as a trade mark?
We state no rule on that. You acquire and protect the right in a national mark by registering it with OSIM. OSIM's register is not the Trade Register, where companies are registered. Ask the partner attorney whether your name needs a filing before you rely on it.
What are the OSIM state fees for one class in 2026, in lei and in euro?
For one class and an individual word mark in black and white, you pay four state fees. Filing is 51 lei / EUR 10. Publication is 152 lei / EUR 30. Examination is 559 lei / EUR 110. The certificate is 254 lei / EUR 50, due once the mark is registered. Colour and figurative marks cost more (fee table above). These state fees are in force from 1 January 2026.
Why does OSIM charge some applicants in lei and others in euro?
OSIM's calculator sets the currency by the applicant. Romanian citizens and legal persons organised under Romanian law pay in lei. Everyone else pays in euro. The 2026 lei amounts are converted at 1 euro = 5.0811 lei, the BNR rate of 1 October 2025. Your currency depends on who the applicant is.
How long does OSIM take to examine a trade mark application?
OSIM publishes an application within at most 7 days of the filing date. It examines the mark on the merits within 6 months of publication, if the fees are paid. Then it admits or refuses the mark. OSIM publishes no official total from filing to certificate. We promise no date and no result.
What happens if someone opposes my trade mark, and how long is the opposition period?
Any interested person can oppose. OSIM's guide gives two months from the BOPI publication of the admission of the application, on the relative grounds of art. 6. The opponent pays the state fee of 305 lei / EUR 60 for one class with the opposition. The partner attorney or a lawyer defends an opposition, not us.
What happens if I miss the examination fee or the certificate fee deadline?
If you do not pay the examination fee, the application ends: OSIM deems the applicant to have withdrawn and rejects it. If you do not pay the 254 lei certificate fee, OSIM treats the registration as given up. OSIM's applicant guide gives 30 days for each, from filing and from OSIM's notice. Another OSIM text differs on both, so we diarise the guide's terms.
How do I choose the Nice classes, and what if I just write the class heading?
List the goods and services precisely, in plain language. The partner attorney classifies them. A class heading is read as covering everything within its literal meaning. Classification by OSIM's examiners costs 152 lei. For an individual mark, each additional class adds an examination fee of 254 lei / EUR 50. Collective and certification marks pay other fees.
How long does a Romanian trade mark last, and how is it renewed?
A Romanian mark lasts 10 years from filing. You can renew it for any number of further 10-year periods. Renewing an individual mark costs 610 lei / EUR 120 for the first class in black and white. In colour, it costs 1,016 lei / EUR 200. A renewal certificate fee comes on top. A late renewal is possible within 6 months after expiry, with the fee raised by 50%.
Can a trade mark be transferred to the company or licensed after registration?
Yes. You can transfer rights in a mark by assignment or licence. Recording a transfer at OSIM carries a state fee of 508 lei / EUR 100. A partner Romanian lawyer prepares the assignment or licence agreement, not us (Law 51/1995 art. 3(1)(c), 3(2)).
I received an invoice for my trade mark renewal or publication: is it official?
Check it before you pay. The EUIPO states on its fees page that it never sends invoices or letters requesting direct payment for services to users. We state no such rule for OSIM. Send us the document, and the partner attorney reads it against your file.
How do I trademark a name internationally?
This page covers two routes. One is a national mark at OSIM, protected in Romania only. The other is an EU trade mark at the EUIPO, with equal effect throughout the Union. We do not cover protection in countries outside the EU through the international system. Raise it with the partner attorney before you file.
Ready to start your OSIM trade mark file?
Tell us who the applicant is, where it is seated and what the mark covers. We reply with the documents and the state fees that apply.
